உச்சநீதிமன்றத்தின் தீர்ப்பை செல்லாததாக்கும் அவசரச்சட்டத்தை ஒன்றிய அரசாங்கம் திரும்பப் பெற வேண்டும் என்று மார்க்சிஸ்ட் கம்யூனிஸ்ட் கட்சி வலியுறுத்தியுள்ளது.
மக்களால் தேர்ந்தெடுக்கப்பட்ட தில்லி யூனியன் பிரதேச அரசாங்கத்தின் உரிமைகளை உயர்த்திப்பிடித்து சமீபத்தில் உச்சநீதிமன்றத்தில் ஐந்து நீதிபதிகள் அடங்கிய அரசமைப்புச்சட்ட அமர்வாயம் அளித்திட்ட தீர்ப்பினை செல்லாததாக்கி, ஒன்றிய அரசாங்கம் பிறப்பித்துள்ள அவசரச் சட்டத்திற்கு அரசியல் தலைமைக்குழு கடும் கண்டனம் தெரிவித்துக்கொள்கிறது. இவ்வாறு அவசரச்சட்டம் பிறப்பித்திருப்பது நீதிமன்ற அவமதிப்பு மட்டுமல்ல, அரசமைப்புச்சட்டத்தின் கூட்டாட்சி அம்சத்தின் மீதும், உச்சநீதிமன்றத்தால் வரையறுக்கப்பட்ட ஜனநாயக அரசாங்கத்தின் செயல்பாடுகள் மீதும், அவை மக்களுக்குப் பதில் சொல்லும் பொறுப்பு ஆகியவற்றின் மீதும் நேரடித் தாக்குதல்களாகும். உச்சநீதிமன்றத்தின் தீர்ப்பையே மீறியிருக்கும் இந்தச் செயலானது, மோடி அரசாங்கத்தின் அப்பட்டமான எதேச்சாதிகார செயலாகும். நாட்டின் நலன் கருதித்தான் இவ்வாறு அவசரச்சட்டம் பிறப்பிக்கப்பட்டிருப்பதாக அது கூறிடும் போலியான காரணங்கள், முத்திரைபதித்த தீர்ப்பு வழங்கிய உச்சநீதிமன்றத்தின் அரசமைப்புச்சட்ட அமர்வாயத்திற்கு நாட்டின் நலன்பற்றி அக்கறையில்லை என்பதுபோல் ஆகிறது. இது, உச்சநீதிமன்றத்தினையே வெளிப்படையாக அவமதித்திடும் செயலாகும்.
இது மக்கள் மற்றும் தில்லி அரசாங்கத்தின் பிரச்சனைகள் மட்டுமல்ல, நாட்டு மக்கள் அனைவரையும் பாதிக்கக்கூடிய, அரசமைப்புச்சட்டம் அளித்துள்ள கூட்டாட்சித் தத்துவத்தினையே புல்டோசர் மூலம் இடித்துத்தரைமட்டமாக்கிடும் செயலாகும். இது எதிர்க்கப்பட வேண்டும். இந்த அவசரச்சட்டம் விலக்கிக்கொள்ளப்பட வேண்டும் என்று மார்க்சிஸ்ட் கம்யூனிஸ்ட் கட்சி கோருகிறது. இவ்வாறு அரசியல் தலைமைக்குழு அறிக்கையில் கூறியுள்ளது.
The Polit Bureau of the Communist Party of India (Marxist) has issued the following statement:
Withdraw this Authoritarian Ordinance
The Polit Bureau strongly condemns the Central government ordinance to nullify the recent Supreme Court judgement by a five member Constitution bench upholding the rights of the elected government of Delhi over major areas of governance including control of the bureaucracy. Not only does this constitute contempt of court, it is a direct assault on the federal character of the constitution and the norms of accountability and democratic governance as defined by the Supreme Court. This defiance of the highest court of the land is a measure of the blatant authoritarian nature of the Modi government. The spurious reasons given that it is in the national interest is an open insult to the court as though the constitution bench was oblivious of national interest when it gave its landmark judgement.
This concerns not just the people and government of Delhi but all citizens concerned with the bulldozing of the constitutional federal framework by the central government. It must be opposed. CPI(M) demands its withdrawal.
